Case 246 – Stonemason told to work during designated hours at cemetery

The enquirer is a stonemason who has been told that they can only work at the local cemetery at certain times, as designated by the Town Council. They claim they were told this is due to the health and safety responsibility the council has towards them.

Panel decision

Inquiries have made clear that the Council have put the requirements – to work within certain hours and to notify of when someone will be working – in place in order that they can better manage activities alongside other users of the cemetery including handling the sensitive issue of mourners at funerals. Health and safety has been incorrectly given as the reason for these requirements and the person should have been given a proper explanation of the reasons.
